This Site is operated by VOESH (“VOESH,” “we,” “us,” or “our”). VOESH offers this Site, including all information, tools, products, and services available through the Site, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting the Site, using any part of the Site, and/or purchasing something from us, you agree to be bound by these Terms of Use (“Terms”), including those additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the Site, including without limitation browsers, vendors, customers, merchants, and contributors of content.

If you do not agree to all of these Terms, you may not access or use the Site. If these Terms are considered an offer, acceptance is expressly limited to these Terms. With respect to any products purchased through the Site, the version of these Terms posted at the time of purchase shall apply.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to the Site. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes. 

2. GENERAL CONDITIONS

By using the Site, you represent and agree that:

Nothing in these Terms grants you any ownership rights in the Site Content. 

4. LICENSE AND PERMITTED USES

VOESH grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Site Content for personal, non-commercial purposes only. Except as expressly permitted, you may not copy, reproduce, modify, republish, upload, post, transmit, distribute, sell, license, rent, or otherwise exploit any Site Content without prior written consent.

This license automatically terminates if you violate these Terms. 

5. ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We do not guarantee that information on the Site is accurate, complete, or current. The Site may contain historical information provided for reference only. Reliance on Site content is at your own risk. We reserve the right to modify the Site at any time without obligation to update information.

6. PRODUCTS AND SERVICES

Certain products may be available exclusively online and in limited quantities. All product descriptions, pricing, and availability are subject to change without notice. We reserve the right to limit quantities, refuse orders, or discontinue products at any time.

Products sold on the Site are for personal use only and may not be resold without written authorization. Orders suspected of resale, distribution, or fraud may be canceled.

We do not warrant that product quality will meet your expectations or that any errors will be corrected.

7. BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate billing and account information. We reserve the right to refuse or cancel orders, limit quantities, or cancel orders using the same account, payment method, or address.

You represent that you are authorized to use the payment method provided.

8. OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties. VOESH is not liable for your use of optional third-party tools.

9. THIRD-PARTY LINKS

The Site may include links to third-party websites. We are not responsible for third-party content, accuracy, or practices. Use of third-party websites is at your own risk.

10. TEXT MARKETING (SMS)

By opting in to receive SMS/text messages from VOESH, you consent to receive recurring automated promotional and informational messages, including marketing messages such as promotions, offers, and cart reminders. Consent is not a condition of purchase.

Message frequency varies. Message and data rates may apply. To opt out, reply STOP. For assistance, reply HELP or email info@voesh.com. Supported carriers are not liable for delayed or undelivered messages. Participation is voluntary and governed by our Privacy Policy.

11. USER COMMENTS, FEEDBACK, AND SUBMISSIONS

If you submit comments, reviews, photos, videos, social media content, or other materials (collectively, “Submissions”), you grant VOESH a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, publish, distribute, display, and create derivative works from such Submissions in any media, including for marketing and advertising purposes.

You represent that you own or control all rights to your Submissions and that they do not infringe the rights of any third party. You are solely responsible for your Submissions.

12. PERSONAL INFORMATION

Your submission of personal information through the Site or SMS program is governed by our Privacy Policy.

13. ERRORS, INACCURACIES, AND OMISSIONS

We reserve the right to correct errors, inaccuracies, or omissions and to cancel orders if information on the Site is inaccurate, at any time without prior notice.

14. PROHIBITED USES

You may not use the Site or its content for unlawful purposes, to infringe intellectual property rights, harass others, submit false information, upload malicious code, scrape content, or interfere with Site security. We reserve the right to terminate access for prohibited uses.

16. DISCLAIMER OF WARRANTIES

17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOESH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

18. INDEMNIFICATION

You agree to indemnify and hold harmless VOESH and its affiliates, officers, employees, and agents from any claims arising from your breach of these Terms or misuse of the Site.

19. COPYRIGHT INFRINGEMENT (DMCA)

VOESH respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). Notices of alleged infringement should be sent to info@voesh.com with the information required under 17 U.S.C. §512(c)(3).

20. SEVERABILITY

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

21. TERMINATION

These Terms remain effective while you access or use the Site. VOESH may suspend or terminate your access to the Site or any portion thereof at any time, with or without notice, if we believe you have violated these Terms or applicable law.

Termination of access will not affect any rights or obligations that by their nature should survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law.

22. GOVERNING LAW

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles.

23. ARBITRATION AND CLASS ACTION WAIVER

Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration on an individual basis, except that you may bring claims in small claims court if eligible. You waive any right to participate in class or representative actions.

24. FORCE MAJEURE

VOESH shall not be liable for delays or failure to perform due to events beyond its reasonable control, including natural disasters, pandemics, labor disputes, or supply chain disruptions.

25. CHANGES TO TERMS OF USE

You can review the most current version of the Terms of Use at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to our Site and the Services following the posting of any changes to these Terms constitutes acceptance of those changes.
